In a significant move to enhance accountability and transparency within the judicial system, Chief Justice Honourable Komba Kamanda has issued a directive stating that no executions shall be conducted by the Under Sheriff’s Office without prior approval from Supervising Judges.
This memorandum, communicated by Deputy Master and Registrar Mrs. Huliamatu F. Christian-Moses on May 6, 2025, aims to empower Supervising Judges and improve the execution process, ultimately ensuring a more timely delivery of justice.
Justice Kamanda emphasized that these measures are designed to strengthen judicial oversight and bolster public confidence in the legal system. “The implementation of this new protocol will help raise much-needed funds for the Government,” he stated, adding that it will eliminate unreasonable fees associated with executions and prevent the misuse of these processes to frustrate court proceedings.
Under the new directives, the Chief Justice instructed that all executions must be approved by Supervising Judges, with such approval documented by their signatures. The sale of property by the Under Sheriff’s Office is also prohibited without prior authorization from the Supervising Judges. Additionally, litigants making payments for execution processes must receive a receipt from the National Revenue Authority (NRA) confirming their payment.
Justice Kamanda further clarified that if additional fees are required for execution processes, a receipt must be provided. Any failure to conduct lawful executions must be reported to the Supervising Judges without delay.
These measures are set to take immediate effect, marking a pivotal change in the administration of court-ordered executions.
