Proceedings in the alleged malicious damage case involving property in Hill Station stalled on Tuesday after the complainant failed to appear before Pademba Road Magistrate Court No. 2.
Magistrate John Manso Fornah granted an application to compel the complainant’s attendance and subsequently adjourned the matter to 29 July 2026.
The three accused men — Joseph Bunduka, also known as Maada, Ibrahim Kanu, and Augustine Kamara — are charged with malicious damage contrary to law. They appeared in court and all pleaded not guilty.
Prosecuting officer Police Constable 18235 TKK told the court that the alleged offence occurred on 10 June 2026 along Kia Kamara Drive, Hill Station. The prosecution claims the defendants damaged a retaining wall valued at Le40,000 and a makeshift structure valued at Le2,500, with the properties said to belong to Santigie Sesay and Aminata Conteh. The total alleged damage is put at Le42,500.
Because the complainant was absent, the prosecution was unable to lead evidence and applied for a subpoena to secure his presence at the next sitting.
Magistrate Fornah reminded the court of the importance of complainants and witnesses in criminal proceedings, noting that their testimony is often necessary for cases to proceed and for evidence to be properly examined.
The three men remain on trial and are presumed innocent until proven guilty.
