ACC BOSS URGES SUPREME COURT TO REFUSE RULING ON CONSTITUTIONAL BILL

FREETOWN – Anti-Corruption Commission Commissioner Francis Ben Kaifala has advised the Supreme Court to exercise judicial restraint and decline to rule on the disputed Constitutional Amendment Bill now before it.

In a social media post titled “Dangerously Educated Opinion”, Kaifala said the Court could lawfully choose not to make a decision after hearing all parties.

“After hearing all sides, the Supreme Court must DECIDE not to Decide! Perfectly LAWFUL,” he wrote.

His comments come at a time of growing tension over the Bill, which Parliament has already passed and is awaiting presidential assent.

Critics, including civil society organizations and the Sierra Leone Labour Congress, have warned that parts of the amendment threaten the direct election of Members of Parliament.

Kaifala’s suggestion implies that the apex court could review submissions from all sides but opt not to issue a substantive judgment on the matter.

Legal observers say while the Supreme Court is the final authority on constitutional interpretation, it retains discretion on how and when to exercise its jurisdiction.

The Bill has emerged as one of the most divisive legislative issues this year, with supporters pushing for assent and opponents demanding clarity on its legality and impact on democracy.

The Court is yet to announce its position on whether it will hear the matter in full or dismiss it.
